1. Introduction and Acceptance

These Terms of Service govern your access to and use of the wptailwatch.com website, the cloud platform (dashboard.wptailwatch.com), the application endpoint ecosystem (api.wptailwatch.com), our native mobile applications distributed via official marketplaces, and any software extensions or plugins produced by WP Tailwatch LLC (collectively, the "Service").

By accessing or installing any component of the Service, or by creating an account, you acknowledge that you have read, understood, and agree to be bound by these Terms and our integrated Privacy Policy available at https://wptailwatch.com/privacy-policy. If you do not accept these conditions, you are expressly prohibited from utilizing the Service.

Explicit Beta Testing Terms

You explicitly acknowledge and accept that WP Tailwatch is currently operating in Beta Version 1.0.0. The application is being actively tested, optimized, and adjusted. By utilizing software in a beta phase, you accept that the codebase may occasionally contain bugs, system glitches, diagnostic reporting errors, or unexpected server connection failures.

The software, mobile connectivity features, and server processing mechanisms are provided completely on an "AS IS" and "AS AVAILABLE" baseline, completely devoid of any express or implied operational warranties.

2. Eligibility and Age Requirement

You must be at least 16 years of age, or the age of legal majority in your jurisdiction (whichever is higher), to create a WP Tailwatch account or accept these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2.1 Explicit Prohibition of Competitive Exploitation

You are strictly prohibited from creating an account, subscribing to our notification network, or downloading our application files if you are an employee, owner, independent contractor, or representative of a direct competitor or alternative WordPress security software company.

You may not access our services, parse our background API structures, track server uptime rhythms, or analyze monitoring endpoints for the purpose of competitive analysis, reverse-engineering, features duplication, or comparative benchmarking. Any violation of this clause represents a material breach of contract and will result in the immediate revocation of your platform access without financial refund, alongside the pursuit of legal remedies for trade secret misappropriation.

3. Definitions

  • "Free Plugin" means the foundational WP Tailwatch WordPress extension distributed via the official WordPress.org directory under GPLv2+ compliance.
  • "Pro Plugin" means the commercially licensed, premium variant of our WordPress extension containing enhanced automation and remediation utilities.
  • "Site" means an independent WordPress installation where you have deployed our software packages.
  • "User Data" means any security logs, server attributes, event metadata, or configuration objects transmitted to our systems by your deployed software.

4. Relationship to the GPL Free Plugin

The core code of the Free Plugin is distributed under the GNU General Public License, version 2 or later ("GPLv2+"). Nothing within these Terms restricts, supersedes, or limits your rights under the GPL regarding that source code.

However, optional features embedded within the software (including central cloud synchronization, remote push notifications, and SOS passwordless recovery tools) require active interactions with our cloud API infrastructure; use of these cloud components is strictly governed by these Terms. The WP Tailwatch brand name, proprietary cloud interfaces, and mobile application binaries remain the exclusive property of WP Tailwatch LLC and are protected under standard intellectual property laws.

5. Account Registration and Security

To access account-required features, you must create a WP Tailwatch account at dashboard.wptailwatch.com. You agree to:

  • Provide accurate, current, and complete information during registration;
  • Maintain and update your account information promptly when it changes;
  • Keep your account credentials confidential and not share them with any third party;
  • Notify us immediately at [email protected] of any unauthorized access to or use of your account;
  • Be responsible for all activity that occurs under your account, whether or not authorized by you.

We may decline to register an account, suspend an account, or terminate an account at our reasonable discretion, including, without limitation, where we believe an account is being used in violation of these Terms.

6. Subscription Grant: Pro Plugin

Subject to your payment of all applicable fees and your continuing compliance with these Terms, WP Tailwatch grants you a non-exclusive, non-transferable, revocable right to install and use the Pro Plugin on the number of WordPress Sites permitted by the subscription tier you purchased.

The Pro Plugin subscription:

  • Is per-Site by default. Multi-Site subscriptions are available; each distinct WordPress installation counts as one Site.
  • Is valid for the term you have paid for (typically annual). Renewal is required to continue receiving software updates, customer support, and access to Pro-only features that depend on the cloud Service.
  • Does not grant you the right to redistribute, transfer, sell, rent, lease, or otherwise reassign the Pro Plugin to any third party.
  • Does not grant you the right to remove or alter the Pro Plugin's account-verification mechanism.
  • Permits modification of the Pro Plugin's source code for your own internal use only.

If your Pro subscription expires or is terminated, the Pro Plugin will continue to function on Sites where it was previously activated, but you will no longer receive updates, security patches, or access to Service-dependent Pro features.

7. Acceptable Use

You agree to use the Service and the Plugins only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service to violate any applicable law, regulation, or third-party right;
  • Attempt to gain unauthorized access to the Service, other WP Tailwatch accounts, or any computer system or network connected to the Service;
  • Interfere with, disrupt, or impose an unreasonable load on the Service infrastructure;
  • Use automated scripts or bots to consume Service resources beyond normal Plugin operation;
  • Resell, white-label, or otherwise commercially redistribute the Pro Plugin or any Service component without WP Tailwatch's prior written consent;
  • Reverse-engineer, decompile, or attempt to derive the source code of any portion of the Pro Plugin's account-verification mechanism or any other technical protection measure (this restriction does not apply to the Free Plugin, which is GPL-licensed and may be freely modified);
  • Use the Service to send unsolicited communications (spam) or transmit malicious code;
  • Submit false, misleading, or fraudulent information to the Service.

8. Service Availability and No SLA

The Service is provided on an "as available" basis. WP Tailwatch does not offer a service-level agreement (SLA) for the Free Plugin or the basic Service tier. We will use commercially reasonable efforts to maintain Service availability but do not guarantee uninterrupted, timely, secure, or error-free operation. The Service may be temporarily unavailable due to maintenance, upgrades, failure of underlying infrastructure providers, or other causes outside our reasonable control.

9. Service Level Availability (SLA) & Maintenance Disclaimers

While WP Tailwatch targets a 99.9% operational uptime standard for our background cloud API endpoints and mobile messaging sync channels, we do not provide a contractually binding Service Level Agreement (SLA).

You explicitly acknowledge that our network availability may be temporarily reduced, interrupted, or dropped due to:

  • Scheduled maintenance windows (which we will attempt to announce at least 24 hours in advance via dashboard notices or email).
  • Emergency architectural scaling or security patching required to block active zero-day infrastructure exploits.
  • Upstream outages affecting our underlying cloud infrastructure providers (e.g., AWS, DigitalOcean).

Temporary operational drops, missed heartbeat checks, or server processing pauses occurring during these service interruptions shall not constitute a material breach of this contract and do not entitle the user to service credits, plan downgrades, or financial compensation.

10. Cloud Synchronization and Remote Processing Architecture

By connecting either the Free Plugin or Pro Plugin to a WP Tailwatch cloud account, you explicitly acknowledge and authorize the deployment of an external, cloud-driven computing infrastructure to deliver the Service's features:

  • Data Synchronization License: The software will securely transmit operational logs, environmental security configurations, firewall events, and real-time notification strings to api.wptailwatch.com. You grant WP Tailwatch a non-exclusive, global, limited license to host, process, and display this data solely to populate your Cloud Dashboard and paired native mobile applications.
  • Remote File Processing License: For malware monitoring, isolation, and automated remediation tasks, you explicitly grant WP Tailwatch LLC a temporary, limited license to securely copy and transfer target website files from your hosting server to our isolated processing nodes. You authoritatively grant our remote systems the right to scan, modify, abstract malicious code segments, and write back cleaned, repaired, or updated file parameters to your server infrastructure on your behalf.
  • Environment Compatibility & Testing: WP Tailwatch modifies code structures remotely to perform malware remediation and optimization. You acknowledge that different server setups, hosting limitations, and third-party plugin conflicts can impact software behavior. It is your responsibility to test major automated updates or cleaning routines within a staging environment. WP Tailwatch LLC is not liable for operational downtime, broken layouts, or database corruption resulting from automated or manually triggered remote file operations.

11. Regional Data Localization Add-Ons and Sovereignty Limits

Certain advanced architectural choices, such as forcing our platform to route all cloud file scanning, data manipulation, and security log caching through specific localized data boundaries (e.g., anchoring execution strictly within the AWS/Google Cloud eu-central region), may be restricted to premium subscription tiers or require the purchase of a standalone Regional Data Localization Add-On.

  • Configuration Accountability: While WP Tailwatch provides the structural toggles to segment file scanning pipelines into regional data centers, you remain solely responsible for ensuring your selection fulfills your regional, organizational, or country-specific legal mandates (e.g., GDPR data sovereignty requirements).
  • Default Routing Consent: If you do not explicitly purchase, configure, and maintain a designated local processing region, you grant the Service the right to route file scanning operations through our automated global load-balancing framework to optimize execution speeds.

12. Mobile Application Distribution and Marketplace Provisos

Subject to continuing compliance with these Terms, WP Tailwatch LLC grants you a limited, non-exclusive, non-transferable, revocable license to run our mobile software on devices you control.

  • You explicitly acknowledge that these Terms are enacted solely between you and WP Tailwatch LLC, and not with Apple Inc. or Google LLC. WP Tailwatch LLC remains singularly liable for application content, security maintenance, and operational debugging.
  • To the maximum extent permitted by applicable law, marketplace infrastructure operators (Apple and Google) possess zero warranty obligations, support duties, or liability claims regarding the operation of the mobile applications.

13. Infrastructure Delivery Network Disclaimers

The structural design of WP Tailwatch relies explicitly on third-party data transmission corridors to push vital alerts directly to your smartphone terminal.

You explicitly recognize and agree that our software does not own, run, or directly control the operation of third-party telecommunications backbones, mobile operating system frameworks, cellular data towers, internet routing pathways, Apple Push Notification networks (APNs), or Google Firebase Cloud Messaging layers.

We disclaim any and all liability connected to delayed, dropped, blocked, intercepted, or corrupted push notification alerts resulting from carrier coverage gaps, server routing crashes, local mobile device settings (such as "Do Not Disturb" profiles or system task-killer applications), or hosting environment firewall parameters that isolate background network traffic.

14. Passwordless Access Tools and Administrative Risk Acceptance

The Service provides advanced passwordless management capabilities, including remote dashboard login bridges, SOS Recovery URLs, and cryptographic mobile device pairing profiles.

  • By enabling these cloud features, you explicitly acknowledge that anyone gaining unauthorized control over your central WP Tailwatch account credentials, API secret values, or paired mobile hardware devices will have administrative command over your linked WordPress installations.
  • You bear total responsibility for enforcing strong password security, deploying two-factor authentication (2FA) on your WP Tailwatch dashboard, and securing physical access locks on mobile devices running our monitoring application.

15. Gmail OAuth: XOAUTH2 SMTP Authorization

If you choose to use Gmail or Google Workspace as the SMTP provider for outbound email from your WordPress Site, the Plugin will guide you through Google's OAuth 2.0 consent flow. By completing that flow you authorize WP Tailwatch to:

  • Receive an OAuth 2.0 refresh token issued by Google;
  • Store that refresh token securely in your own WordPress database;
  • Use the refresh token solely to obtain short-lived access tokens from Google endpoints to authenticate your WordPress site's direct outbound SMTP connection.

The content of your emails is transmitted directly from your server to Google's SMTP endpoints. It does not pass through WP Tailwatch servers and is never read or stored by us. You can revoke this authorization at any time by deleting the connection settings inside the Plugin or via your Google Account security settings.

16. Intellectual Property and Trademarks

The WP Tailwatch name, logo, website designs, dashboard interface, cloud API code, mobile app binaries, and all related documentation are the exclusive intellectual property of WP Tailwatch LLC and are protected by copyright, trademark, and other applicable laws. You may not use our trademarks, brand names, or logos without our prior written consent. The WordPress® trademark and logo are the property of the WordPress Foundation. WP Tailwatch is an independent software product and is not affiliated with, endorsed by, or sponsored by the WordPress Foundation.

C. Strict Prohibition of AI Training and Automated Content Scraping

All text strings, technical blog posts, threat analysis diagrams, security blueprints, code examples, and documentation assets found on wptailwatch.com are the proprietary intellectual property of the Company.

You are strictly prohibited from using automated web scrapers, data miners, bots, extraction tools, or scripts to crawl, parse, download, or index our content for the purpose of training Artificial Intelligence (AI) models, Large Language Models (LLMs), automated machine learning systems, or commercial data synthesis engines without our explicit, prior written licensing contract. Any unauthorized scraping for AI training optimization constitutes an absolute violation of our intellectual property rights.

17. Disclaimers and Limitations of Liability

THE SERVICE AND PLUGINS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

WP TAILWATCH LLC DOES NOT WARRANT THAT MALWARE DETECTION OR REMEDIATION TOOLS WILL RESOLVE 100% OF SECURITY THREATS, OR THAT REMOTE SECURITY ACTIONS WILL REMAIN COMPLETELY ERROR-FREE ACROSS ALL POSSIBLE SERVER CONFIGURATIONS. YOU REMAIN SOLELY LIABLE FOR ENFORCING PARALLEL, INDEPENDENT OFFSITE BACKUPS OF YOUR CORE WORDPRESS SERVER ASSETS.

IN NO EVENT SHALL WP TAILWATCH LLC'S AGGREGATE LIABILITY EXCEED THE TOTAL VALUE OF FEES PAID BY YOU TO WP TAILWATCH LLC FOR THE SPECIFIC SUBSCRIPTION TERM ASSOCIATED WITH THE DISPUTED EVENT.

18. Comprehensive Disclaimer of Warranties

WP TAILWATCH AND ITS ASSOCIATED COMPONENT ENGINE WORKFLOWS ARE PROVIDED STRICTLY ON AN "AS IS" STRIPPED FRAMEWORK. THE COMPANY MAKES NO EXTENSIVE GUARANTEES, REPRESENTATIONS, OR EXPRESS WARRANTIES REGARDING APPLICATION PERFORMANCE, ARCHITECTURAL FAULT IMMUNITY, OR FUNCTIONAL RELIABILITY.

WE EXPLICITLY DISCLAIM ALL WARRANTIES, EXTENDING TO THE IMPLIED INDEMNITY STRINGS OF MERCHANTABILITY, FITNESS FOR A SPECIFIC PURPOSE, NON-INFRINGEMENT OF ASSETS, AND OPERATIONAL TIMELINESS.

CYBERSECURITY IS AN INHERENTLY SHIFTING ARMS RACE. ADVANCED MALWARE DESIGNS, ZERO-DAY SERVER EXPLOITS, OR HIGHLY COMPLEX UI-EVASION SCRIPTS MAY TEMPORARILY OR PERMANENTLY CIRCUMVENT LOCAL THREAT FILTERS. WE DO NOT WARRANT, PROMISE, OR GUARANTEE THAT THE PLATFORM WILL IDENTIFY 100% OF SYSTEM BREACHES, ACCURATELY STOP ALL INSTANCES OF FILE MANIPULATION, PREVENT EVERY FORM OF ACCOUNT ELEVATION, OR LOG EVERY MALICIOUS ACTION ON YOUR SERVER. YOU ARE EXPLICITLY WARNED NOT TO DEPLOY THE SOFTWARE AS A SINGLE POINT OF SECURITY FAILURE.

19. Indemnification

You agree to defend, indemnify, and hold harmless WP Tailwatch LLC, its providers, and its employees from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your misuse of the Service.

20. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the jurisdiction in which WP Tailwatch LLC is organized, without giving effect to any choice or conflict of law provision. Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the courts of that jurisdiction.

A. Mandatory Binding Arbitration

You and WP Tailwatch agree that any legal controversy, claim, or dispute arising out of this contract that cannot be resolved through informal customer support channels shall be settled exclusively through binding, individual arbitration managed by a recognized arbitration association in our corporate home jurisdiction, rather than in a court of law. The arbitrator's decision shall be final, binding, and enforceable in any court of competent jurisdiction.

B. Comprehensive Class Action Waiver

YOU AND THE COMPANY EXPLICITLY AGREE THAT ANY DISPUTE RESOLUTION ACTIONS OR ARBITRATION PROCEEDINGS SHALL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL CAPACITY.

You explicitly waive your legal right to file, join, or participate as a plaintiff or class member in any class-action lawsuit, class-wide arbitration, or consolidated legal action targeting WP Tailwatch, its developers, or its foundational corporate entity.

21. Severability and Waiver

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be eliminated or minimized to the minimum extent necessary so that the remaining provisions of the Terms will continue in full force and effect. No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver.

22. Termination and Cloud Erasure

We reserve the right to suspend or disable your cloud access tokens or terminate your account at our reasonable discretion if you violate these Terms, execute infrastructure abuse against our scanning arrays, or engage in unlawful behavior. You may terminate your account relationships at any time by triggering the data purge function within your Cloud Dashboard or mobile application profile settings.

23. Entire Agreement

These Terms of Service and our Privacy Policy constitute the sole and entire agreement between you and WP Tailwatch LLC regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
